Minutes of the 20th ANNUAL MEETING
May 23, 2009
Location: The Pavilion
Vice President Frank Dietrich formally opened the
meeting at 11:10 A.M. It was determined that there was a quorum of Members
necessary as specified in the By-Laws of the Association. The following lots
were represented at the meeting: 2, 4, 8, 9, 10, 11, 15, 17, 19, 21, 22, 26,
27, 28, 36, 38, 44, 45, 46 & 47. Frank asked each of those present to introduce
themselves to the others at the meeting.
Minutes of 2008 Annual Meeting had been posted on the website and copies were
made available at this meeting. The Minutes were unanimously approved as
written.
Secretary-Treasurer’s Report
Secretary-Treasurer Jay Youngquist reported that he had mailed the Notice of
Annual Meeting to Members of record on May 22, 2009, which was at least 30 days,
but not more than 60 days, before the meeting, as required by law.
Jay then presented a 2008 year-end financial report, which showed
a Balance of Funds of $40,845 as of the end of 2008. The report also included a
May 23, 2009 Balance Sheet, 2009 Statement of YTD Revenues & Expenses, 2009 YTD
Budget Status, and 10-Year Financial History (1999-2008). As of the meeting,
there were five 2008 unpaid accounts receivable for 2009 annual dues. Final
Notices had been sent to those delinquent lot owners. There was information
received that one lot (22) had recently been sold and the closing was scheduled
for June 5th, at which time it was expected that the outstanding dues
and late fees would be collected. If the remaining dues and late fees are not
received by the end of May, in accordance with our By-laws, liens will be filed
for the remaining lots and formal letters sent advising of the owners that they
are prohibited from using the Association’s common areas until their account is
paid-in-full.
Jay reported that there over-budget expenditures in a couple budget line
items due to the cost of additional ballot materials and mailings and the
decision to go ahead with leaf and sapling removal from the Association’s
roadside gullies and park area. The 2008 corporate taxes for federal and state
taxes had been paid.
There were no questions pertaining to the Treasurer’s report and it was approved
as presented.
Report of the Environment Control Committee
Jay Youngquist gave a short report of the current status of the make up of
Lakeshore Woods Subdivision. He reported that there are 43 owners of the 52
Lakeshore Woods lots, 30 homes were now built (including one under
construction), there were 7 full-time residences, 8 lots currently known to be
for sale (2 with homes), and there were 2 lot sales (one with a home and one
closing in June) in the past year.
Pat Herrity had repaired a sink hole that had developed near the beach
steps. Recently, the slip numbering had been completed so that all slips are
readily identifiable. The port-o-potty had been cleaned, opened, and service
resumed. Leaves and saplings have been removed from the road and park gullies,
as mentioned earlier. Another trash receptacle had been placed by the trash
collector and service is now on Mondays. Additional, swim safety lines have
been purchased to mark underwater hazards and the swim area and will be
installed soon. In order to reduce mowing costs to within budget, the park area
will only be mowed semi-monthly (rather than weekly) along with the roads.
Pat Herrity has been mowing the beach area, as needed, in the off weeks.
The Association is addressing problems related to the false advertising of one
of our lot owners as to the availability of our Common Areas to their renters
and their unauthorized use of the Common Areas. We have involved the
Association’s legal counsel to help rectify the situation. Questions were asked
by the membership about the problems that had been experienced over the past
year and how they are being addressed. There was general concern expressed
about crowding, liability, behavior, increased wear-and-tear and damage being
done to the Association’s property by these unaccompanied non-Members. At the
recommendation of the Association’s legal counsel, “Private Property” signs
stating that guests must be accompanied by lot owners and “No Diving from Docks”
signs had been purchased and will be installed shortly. Unaccompanied
non-members will be advised of our Covenants and asked to comply and, if
necessary, local authorities will be contacted for enforcement.
Kevin and Eve Willis have volunteered to spruce up the Lakeshore Woods
entrance sign area again this year.
There has been generally good compliance to the Association’s Protective
Restrictions and Covenants.
Future projects under consideration are; retreating of the
park area decks, boat launch reconstruction, wash out repairs. In addition, a
board committee has been formed, chaired by Kevin Willis, to consider
solutions for our slips and piers.
Election of New Directors
There were 3 director positions to be filled. Four Members had expressed
interest in serving on the board; Randy Cassada, Frank Dietrich,
Pat Herrity, and Cheryl Oros. Ballot materials had been sent to
each lot owner along with the Notice of Annual Meeting. Laura McDowall
and Jerry Perkins served as election tellers to open and tally the
votes. Randy Cassada, Frank Dietrich, and Pat Herrity were
elected to 3-year board terms. Cheryl Oros was thanked for her interest
in serving on the board and was encouraged to seek board membership again in
future elections.
New Business
The date of the Association’s annual picnic was set for Saturday, July 4th
at the Pavilion. Nancy Herrity & Boo Perkins volunteered to, once again,
spearhead the effort this year. “Invitations” will be sent out in June and
posted to the website.
The next Annual Meeting will be held on Saturday, May 29, 2010 (Memorial Day
weekend).
There being no further business, the meeting was adjourned at 11:56 A.M.
